These Terms govern your use of the OUTDO Service during its pilot phase. By accessing or using www.outdoapp.com you agree to be bound by them. Questions? Write to hello@outdoapp.com.

01 Operator Identity

This Service is operated by OUTDO APP and affiliates ("OUTDO", "www.outdoapp.com" or "we"):

02 Acceptance of Terms

  1. By accessing or using www.outdoapp.com ("Service"), you agree to be legally bound by these Terms.
  2. If you are using the Service on behalf of an educational institution, you represent that you have authority to bind that institution.

03 Description of Service

The Service is a software platform to help schools understand student engagement and identify at-risk students early through behavioral patterns derived from goal-based activity.

Through a structured, goal-based system, institutions gain visibility into how students engage, where they struggle, and when to intervene — all in one platform.

Pilot Status

The Service is currently provided as a pilot / beta offering. Features may be incomplete, unstable, or subject to change without notice.

04 Eligibility

You must:

  1. Be at least 18 years old, OR
  2. Be authorized to use the Service by your educational institution.

If you are under 18, you represent that your institution has obtained any required parental or legal consent.

05 Accounts

To use the Service, you must create an account and provide:

  1. Name
  2. Email
  3. Student or institutional ID
  4. College name
  5. Class information

You agree:

  1. To provide accurate information.
  2. To keep login credentials secure.
  3. That you are responsible for all activity under your account.

We may suspend or terminate accounts at any time.

06 Institutional Use

If the Service is used by a college or instructor:

  1. The institution is responsible for ensuring lawful use of the Service.
  2. The institution confirms it has the right to share student data with us.
  3. The institution remains the data controller for student data where applicable.

07 Data Protection & Privacy

We collect and process personal data including:

  1. Identity data (name, student ID)
  2. Contact data (email)
  3. Academic context (classes, assignments)

We:

  1. Do not sell personal data.
  2. Use data solely to provide and improve the Service.

Where applicable:

  1. We act as a data processor on behalf of educational institutions.
  2. Processing is subject to applicable laws including GDPR.

08 Educational Data Disclaimer

We acknowledge that certain data may be subject to U.S. educational privacy laws (including FERPA).

By using the Service:

  1. Institutions represent they have authority to disclose such data.
  2. We process such data solely to provide the Service.

We do not independently verify FERPA compliance by institutions.

09 Acceptable Use

You agree not to:

  1. Violate any applicable laws or regulations.
  2. Attempt unauthorized system access.
  3. Interfere with platform operation.
  4. Use the Service for fraudulent or harmful purposes.

10 Intellectual Property

  1. All software, design, and content of the Service are owned by or licensed to OUTDO APP.
  2. You are granted a limited, non-exclusive, non-transferable license to use the Service.

11 No Academic Guarantee

The Service is a tool only.

We do not guarantee:

  1. Academic outcomes
  2. Accuracy of assignments or data
  3. Submission success or grading results

Users remain solely responsible for:

  1. Meeting deadlines
  2. Verifying submissions
  3. Academic performance

12 Pilot / Beta Disclaimer

To the maximum extent permitted by law, the Service is provided:

  1. "AS IS"
  2. "AS AVAILABLE"
  3. With no warranties of any kind

We explicitly disclaim:

  1. Reliability
  2. Availability
  3. Error-free operation
  4. Data preservation guarantees

13 Limitation of Liability

To the maximum extent permitted by law, OUTDO APP shall not be liable for:

  1. Loss of academic data
  2. Missed deadlines
  3. Academic penalties
  4. Indirect or consequential damages
  5. Loss of profits, data, or opportunities

Total liability is limited to whichever is lower of:

  1. €100 (or USD equivalent), or
  2. The amount paid (if any).

14 Indemnification

You agree to indemnify and hold harmless OUTDO APP from any claims arising from:

  1. Your use of the Service.
  2. Your violation of these Terms.
  3. Your institution's misuse of the Service.

15 Termination

We may suspend or terminate access:

  1. At any time
  2. Without notice
  3. For any reason

Upon termination, access to data may be lost.

16 Data Retention

  1. We may retain or delete data at our discretion during and after the pilot.
  2. We do not guarantee data availability after termination of the pilot.

17 Governing Law

This Agreement is governed by the laws of Portugal.

18 Dispute Resolution

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Porto, Portugal.

19 Changes to Terms

  1. We may update these Terms at any time.
  2. Continued use constitutes acceptance.
